- Tianeptine: Illegal (Schedule I). HB 21 (enacted July 21, 2025).
- Phenibut: Not scheduled. (Use FDA guidance that it is not a lawful dietary ingredient.)
- Kratom: Legal statewide (no ban as of 2025); regulation proposals recur.
- Nitrous oxide / inhalants: Misuse prohibited. 11 Del. C. § 627 outlaws intentional inhalation “to get intoxicated” (medical/dental anesthesia excepted).
- THC / Cannabis: Adult-use legal. HB 1 / HB 2 (2023) legalized possession and set up the market; implementation evolving.
- Salvia divinorum / Salvinorin A: Illegal (Schedule I) since 2006 (“Brett’s Law”).
- Amanita muscaria: Not scheduled.
- “Mad honey”: No DE-specific ban; treat as food hazard.
Parent tip: Products sold next to snacks can still be controlled substances. Read labels and ask stores to keep drug-like items out of kids’ view.
