Nevada (NV) — What’s Legal
Checked Oct 13, 2025 • Parent-friendly summary (not legal advice).
- Tianeptine: Schedule I — placed in NV Schedule I in 2023 (NAC 453.510 / AB 336). Possession or sale is a felony.
- Phenibut: Not scheduled statewide; FDA says phenibut is not a lawful dietary ingredient (supplement sales are misbranded).
- Kratom (mitragynine / 7-OH): Legal / regulated under the Kratom Consumer Protection Act (NRS 597.995): registration & testing, 18+, no adulterants or synthetic 7-OH, truthful labeling.
- Nitrous oxide / inhalants: Illegal to sell or use for intoxication (NRS 454.511), with exceptions for legitimate medical/industrial/culinary uses.
- THC / Cannabis: Adult-use legal; regulated by the Nevada Cannabis Compliance Board. 21+ may possess up to 1 oz flower or ⅛ oz concentrate.
- Salvia divinorum / Salvinorin A: Schedule I statewide (NRS 453.510).
- Amanita muscaria (muscimol): Not scheduled; products still must meet general safety/labeling laws.
- “Mad honey” (grayanotoxins): No NV-specific ban; treat as a food hazard (risk of bradycardia, hypotension, neuro symptoms).
Parent tip: NV allows legal cannabis but cracks down on inhalant misuse and mislabeled “boosters.” Avoid products listing DMHA/PEA or “enhanced kratom (7-OH).”
